Terms of Service

Effective date: July 16, 2026

These Terms of Service (“Terms”) are a legal agreement between you and Barzxwaz, the owner and operator of Kokar (“Kokar”, “we”, “us”, or “our”), based in the Kurdistan Region, Iraq. They govern your access to and use of the Kokar website and application (the “Service”).

By creating an account or otherwise using the Service, you agree to these Terms. If you're accepting these Terms on behalf of an organization, you confirm you have the authority to bind that organization, and “you” refers to both you and the organization.

1. Eligibility

You must be at least 16 years old to use the Service. By using Kokar, you confirm you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

You're responsible for the accuracy of the information you provide when creating an account, and for keeping your login credentials confidential. You're responsible for all activity that happens under your account, so let us know right away (support@kokar.krd) if you suspect unauthorized access.

You may sign in with a password or with a Google account. Either way, you're responsible for keeping that sign-in method secure.

3. Description of the Service

Kokar is a workspace for managing projects, tasks, documents, and team communication. Features, plans, and limits may change over time as we improve the Service — we'll do our best to give you reasonable notice of changes that materially reduce functionality you rely on.

Some features (for example, certain AI-assisted features) may be offered on a limited free-use basis regardless of your subscription plan; the current limits are shown in the product.

4. Subscriptions, Billing & Payment

Paid plans are billed per organization. Payments are processed by our payment processor, Nass; we don't store your full card or payment account details ourselves.

Kokar does not automatically renew subscriptions. You (or your organization's owner) need to actively renew before the current subscription period ends. If it ends without renewal, we immediately freeze the organization's workspace — every member is restricted from taking further actions (creating or editing tasks, documents, messages, and similar) until the subscription is renewed. Freezing does not delete your data; renewing restores full access.

Except where required by applicable law, or expressly stated otherwise at the time of purchase, payments are non-refundable. You can cancel a subscription at any time; access continues until the end of the period you already paid for.

Downgrading to a lower-tier plan is different from cancelling: a downgrade takes effect immediately. You lose the higher plan's features right away, and any remaining time on the subscription you had already paid for is forfeited and non-refundable. We show a clear warning before a downgrade is confirmed.

5. Acceptable Use

When using the Service, you agree not to:

  • Use it for anything unlawful, or in a way that infringes someone else's rights.
  • Upload or share content that is defamatory, fraudulent, or malicious (including malware).
  • Attempt to gain unauthorized access to any account, system, or data that isn't yours.
  • Reverse engineer, scrape, or attempt to extract the Service's source code or underlying data at scale, except where the law gives you the right to do so.
  • Interfere with or disrupt the integrity or performance of the Service (e.g. overloading it, attempting to bypass rate limits or security controls).
  • Impersonate any person or entity, or misrepresent your affiliation with one.

6. Your Content

You retain ownership of the tasks, documents, messages, files, and other content you or your organization create in Kokar (“Your Content”). You grant us a limited license to host, store, process, transmit, and display Your Content solely as needed to provide and improve the Service to you.

You're responsible for Your Content and for having the necessary rights to upload and share it.

7. Intellectual Property

Kokar, including its software, design, branding, and underlying technology, is owned by Barzxwaz and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logos, or brand assets, and don't transfer ownership of the Service to you. Except for Your Content (§6), all rights in the Service remain ours.

8. Third-Party Services

The Service relies on third-party providers to operate, including Google (for sign-in), Stream/GetStream.io (for audio/video calls), and Nass (for payments). We aren't responsible for the availability, acts, or omissions of these third parties, though we choose providers we consider reliable.

9. Termination & Suspension

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or as described in §4 (non-payment). Where reasonably possible, we'll try to give you notice before doing so.

Sections that by their nature should survive termination (e.g. §7 Intellectual Property, §11 Limitation of Liability, §12 Indemnification) will continue to apply after your access ends.

10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, Barzxwaz and Kokar won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you (or your organization) paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold Barzxwaz and Kokar harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, Your Content, or your violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the Kurdistan Region, Iraq. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the Kurdistan Region, Iraq.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you (by email or a notice inside the Service) before the change takes effect. Continuing to use the Service after a change becomes effective means you accept the updated Terms.
